Electricity price damper for SMEs, local authorities and bodies not covered by the price shield
Section IX of Article 181 of the 2023 Finance Act requires electricity suppliers to cut the 2023 supply price for customers not covered by the regulated price shield, with the State compensating the loss. Decree No. 2022-1774 of 31 December 2022 defines the beneficiaries (SMEs with fewer than 250 employees, public bodies with fewer than 250 staff, bodies mainly funded by public money, local authorities, micro-businesses with meters above 36 kVA) and sets the parameters: the State covers 50% of the gap between the contract's energy price and €180/MWh, up to a price of €320/MWh.

Measure impact
The reduction is applied on the bill to a share of delivered volumes, capped at 90% of historical consumption. The total 2023 benefit is capped at €2m per entity (€250,000 for primary agricultural production, €300,000 for fisheries and aquaculture). A sworn statement must be sent to the supplier.
