More flexible regime for business founder share warrants (BSPCE)
Article 141 of the act of 6 August 2015 relaxes the BSPCE regime (article 163 bis G of the General Tax Code). A company may now grant these warrants to employees and executives of subsidiaries in which it holds at least 75%, and companies resulting from a restructuring may issue them under conditions. For the reduced tax rate, the three-year seniority may take into account time spent in the parent company or subsidiary. Eligible listed companies must have a market capitalisation below €150 million, and all must have been registered for less than fifteen years.
