Civil servants: one-year child credit opened to fathers and subject to a career break
Article 48 of the pension reform Act rewrites Article L. 12 b of the Civil and Military Pensions Code. The one-year credit per child, previously reserved for female civil servants, is granted to male and female civil servants and military personnel for each child born, adopted or taken in before 1 January 2004, provided they interrupted their work under conditions set by decree. Women who gave birth during their studies, before recruitment, receive it without the career-break condition. According to the explanatory memorandum, the change implements the Community principle of equal pay for men and women (Griesmar judgment of the Court of Justice of the European Communities, 29 November 2001). It applies to pensions awarded from 28 May 2003.
