Company social solidarity contribution (C3S) extended to mutual insurers and provident institutions
Article 8 of the 2005 Social Security Financing Act rewrites Article L. 651-1(9°) of the Social Security Code. Credit institutions and insurance companies remain directly liable for the company social solidarity contribution (C3S), which had until then depended on the financial institutions contribution abolished in 2005, and mutual insurers and provident institutions are brought within its scope. For these bodies, the base is premiums and acceptances net of cessions, excluding 'solidarity' supplementary health contracts, contracts exempt from insurance tax (Article 995(15°) and (16°) of the General Tax Code) and management fees for compulsory schemes. According to the explanatory memorandum, the exemption based on legal form did not comply with EU state aid law. It applies to the contribution due from 1 January 2005.
