Medicines safeguard clause: amount M set at €22.10bn for 2026, generics excluded
Section VIII of Article 28 of the 2026 Social Security Financing Act sets at €22.10bn for 2026 the amount M under Article L. 138-10 of the Social Security Code, the turnover threshold for reimbursable medicines above which the safeguard clause is triggered. Point 2 of section I excludes from the clause's base generic medicines and reference products reimbursed at a flat rate or at the same price as their generics, and states that no rebates other than those under Article L. 138-9 are deducted. Amount M falls compared with previous years because the clause's yield is transferred to the new supplementary turnover contribution.
