Renewable energy contracts for difference: repayment of revenue above a threshold price, and revision of 2006-2010 solar feed-in tariffs from 1 January 2025
Article 183(I) of the 2026 Finance Act amends, from 1 January 2022 to 31 December 2050, the remuneration supplement contracts (Articles L. 311-12 and L. 314-18 of the Energy Code) that capped the amounts owed by producers when the monthly energy premium is negative. An order of the ministers for energy and the budget, issued after a public opinion of the Energy Regulatory Commission, sets a threshold price per technology for each year. Where the contract's reference tariff is at least equal to the threshold price, the producer must repay the full negative premium; otherwise it repays the gap between the market price and the threshold price, multiplied by the volume injected. Paragraph II sets 1 January 2025 as the effective date of the regulatory revision of solar purchase tariffs adopted under Article 225 of the 2021 Finance Act.
