Creation of mobility leave, whose pay receives the social security treatment of the redeployment leave allowance
Article 48 of Act no. 2006-1770 of 30 December 2006 creates mobility leave (Article L. 320-2-1 of the Labour Code), which companies with at least 1,000 employees that have signed a workforce planning (GPEC) agreement may offer. The leave, taken during the notice period and possibly beyond, includes support, training and work periods; accepting it ends the contract by mutual agreement. Pay during the part of the leave exceeding the notice period, at least equal to the redeployment leave allowance, is subject for up to the first nine months to the same social contribution rules as that allowance, i.e. exempt from social security contributions. The Act was published in the Official Journal of 31 December 2006.
