Creation of family support leave with free old-age insurance coverage
Article 125 of the 2007 Social Security Financing Act creates family support leave (Articles L. 225-20 to L. 225-27 of the Labour Code): an employee with at least two years of service may suspend work to care for a relative with a particularly severe disability or loss of autonomy. The unpaid leave lasts three months, is renewable and may not exceed one year over a whole career. During the leave, the employee is affiliated to the general scheme's old-age insurance (AVPF) subject to an income ceiling (that of the family supplement), with contributions reimbursed by the National Solidarity Fund for Autonomy (CNSA). Self-employed workers who stop working for the same reason are covered on the same terms. Decree No. 2007-573 of 18 April 2007 (Official Journal of 20 April 2007) sets the application and affiliation procedures. Family support leave was replaced by caregiver leave (congé de proche aidant) created by Act No. 2015-1776 of 28 December 2015 on adapting society to ageing; free old-age insurance affiliation for caregivers continues.
