€35 legal aid contribution per court case
Article 54 of the amending finance act of 29 July 2011 creates a €35 legal aid contribution payable by the party bringing civil, commercial, labour, social or rural proceedings before a judicial court, or proceedings before an administrative court (Article 1635 bis Q of the General Tax Code). Legal aid recipients, the State and certain proceedings (over-indebtedness, insolvency, immigration cases, urgent interim relief, juvenile judge, etc.) are exempt. The proceeds go to the National Bar Council to fund legal aid, in particular lawyers' assistance during police custody. The contribution applies to proceedings brought from 1 October 2011; a decree of 28 September 2011 sets out the details. It was abolished for proceedings brought from 1 January 2014.
