Contribution from nuclear and hydro power producers to fund the transitional regulated tariff (TaRTAM)

Article 16 of the Act of 7 December 2006 on the energy sector inserts Article 30-2 into Act No. 2004-803 of 9 August 2004: suppliers serving customers at the transitional regulated market adjustment tariff (TaRTAM, the « return tariff ») are compensated when their supply cost exceeds the revenue from this tariff. Compensation is funded partly by a share of the contribution to the public electricity service (CSPE), up to €0.55 per megawatt-hour, and partly by a contribution from producers operating more than 2,000 megawatts of installed capacity, based on their previous-year nuclear and hydro output and capped at €1.30 per megawatt-hour. Decree No. 2007-689 of 4 May 2007 (Official Journal of 5 May 2007) organises the scheme, managed by the Caisse des dépôts on proposals from the Energy Regulatory Commission, with effect for the quarters elapsed since 1 January 2007; the 2007 unit contribution owed by EDF and CNR was set by an order of 9 July 2007. The scheme ended with the TaRTAM.
