Creation of the international tax credit for executive production in France of foreign films and audiovisual works
Article 131 of the 2009 Finance Act creates Article 220 quaterdecies of the General Tax Code: production companies subject to corporate income tax that act as executive producers in France for fiction or animation works produced by companies based outside France receive a tax credit of 20% of their production spending in France (pay of authors, performers and crew, technical services, transport and catering). Works must include elements linked to French culture, heritage or territory, involve at least €1 million of eligible spending and, for fiction, at least five shooting days in France. The base is capped at 80% of the production budget and the credit at €4 million per work. It applies to spending incurred between 1 January 2009 and 31 December 2012. The article entered into force the day after publication of Decree No. 2009-1464 of 30 November 2009.
