Creation of the contingency deduction (DPA) for insured farmers
Article 82 of the 2002 Finance Act creates Article 72 D bis of the General Tax Code. Farmers taxed under a real regime and insured against crop damage or livestock mortality may, under an option valid for five financial years, deduct from their profit an amount capped at €3,000 or 40% of profit up to €12,000, increased by 20% of the share of profit between €30,000 and €76,000. The deduction requires an equivalent amount to be placed in a dedicated account; the sums must be used within five years in the event of a farming contingency defined by decree or for the uses of the investment deduction, failing which they are added back to profit.
