Combined work and retirement: entitlement to a second pension
Article 26 of the 2023 amending social security financing law allows retirees who fully combine their pension with work ('full' combination) to build new rights in the basic schemes, which had been impossible since 2015. These rights give rise to a second pension, paid at the full rate, without any increase or supplement, and capped: Decree No. 2023-753 of 10 August 2023 sets the annual cap at 5% of the annual social security ceiling. Only contributed periods count; if work resumes with the last employer, a waiting period applies. Rights built since 1 January 2023 count for pensions claimed from 1 September 2023.
