Income tax exemption for child maintenance payments received
Additional article adopted by the National Assembly at first reading. A new paragraph in article 80 septies of the General Tax Code would exempt from income tax the sums received by a parent as the other parent's contribution to a child's upkeep and education (articles 371-2, 373-2-2 and 373-2-5 of the Civil Code). Applies from the taxation of 2026 income. The deduction available to the paying parent is not changed by the amendment.

Translation: The mother who bears this tax burden also benefits from a family quotient that is capped. The current system is therefore totally unfair.
Translation: The Ecologist and Social group supports these amendments, which exempt child maintenance from income tax, with a preference for those that also remove the deduction for the paying parent.
Translation: If the law is to change, it must change on both sides; in other words, if it is no longer taxed for the recipient, the sums must no longer be deductible for the payer.
Translation: There are, however, worthwhile solutions, which the minister mentioned: for example, removing the cap on the family quotient for the person who receives child maintenance. Otherwise you risk weakening the recipients of child maintenance.
Translation: We will keep repeating it: child maintenance is not income, but the contribution of the non-custodial parent
Translation: Taxing child maintenance means taxing the same expense twice; it inflicts a double penalty on custodial parents who are sometimes already in difficult situations.
Translation: This amendment has a simple aim: to stop including child maintenance in the taxable income of the parent who receives it. Maintenance is not personal income.
