Gift and inheritance duties adapted to the reform of successions and gifts
Articles 42 to 54 and 59 to 61 of the 2006 Amending Finance Act adapt gift and inheritance duties to the new instruments created by Act no. 2006-728 of 23 June 2006 reforming successions and gifts, in force on 1 January 2007. Cross-generational gift-partitions are taxed according to the relationship between the donor and each beneficiary; successive and residual gifts are taxed only once; early waiver of the reduction action, the statutory right of return and the surviving spouse's or civil partner's temporary housing right are not subject to duties; rent repaid by the estate to the surviving spouse or partner is deductible; gifts by heirs to State public bodies are exempt. Most provisions apply to estates opened and gifts made from 1 January 2007.
