Three-quarters exemption from inheritance and gift duties on undeveloped land in Natura 2000 sites
Article 71 of the 2005 Amending Finance Act adds a 7° to Article 793, 2 of the General Tax Code. Inheritances and gifts of undeveloped land, other than woods and forests, located in a Natura 2000 site are exempt from transfer duties for three quarters of their value. The deed must include a certificate from the departmental agriculture directorate attesting to a management commitment consistent with conservation objectives, and the heir or donee must undertake to apply for eighteen years management guarantees defined by decree. The exemption cannot be combined with another exemption from gift and inheritance duties and is extended to the wealth tax (Article 885 H).
