Real estate capital gains exemption extended to the first two sales of their French home by non-residents
Article 27 of the 2005 Amending Finance Act amends Article 150 U, II, 2° of the General Tax Code. The real estate capital gains exemption available to non-resident EU nationals selling their home in France, until then limited to one residence per taxpayer, is extended to the first two sales. The second sale is exempt only if the taxpayer owns no other property in France on that date and if it takes place at least five years after the first. Previous conditions still apply: tax residence in France for at least two years beforehand and free use of the property. The measure applies to sales made from 1 January 2006.
