Insurance contracts tax: exemption for "solidarity" health contracts whatever the insurer
Article 63 of the 2001 Amending Finance Act amends Articles 995 and 999 of the General Tax Code. Health insurance contracts taken out with mutual societies and provident institutions lose their exemption based on the status of the insurer. Instead, the following are exempt whatever the insurer: optional individual or group health contracts for which no medical information is collected and premiums do not depend on health status, and compulsory group contracts whose premiums do not depend on health status. The measure applies to premiums falling due from 1 October 2002. Article 16 of the 2003 Finance Act extends, from the same date, the group insurance rules of Article 998 to group operations of provident institutions and mutual societies.
European origin
EUA positive amount is revenue or savings for public finances; a negative amount is a cost or lost revenue.
Measure impact
Before the reform, the same supplementary health contract was taxed at 7% with an insurance company and exempt with a mutual society or provident institution. From 1 October 2002, the exemption depends on the features of the contract (no medical selection) rather than on the status of the insurer. The Senate estimates the cost at €94 million in a full year for FOREC, to which the tax is allocated.
