Medicines with low medical benefit: end of the co-payment exemption for patients with long-term conditions

Decree No. 2026-285 of 16 April 2026 provides that insured persons exempt from co-payment because of a long-term condition (ALD, Article R. 160-11 of the Social Security Code) now bear the co-payment set by point 14 of Article R. 160-5 for medicines whose medical benefit is rated low. It also restricts the co-payment exemption linked to an occupational accident or disease pension to the pension holders themselves, excluding their dependants. The decree takes effect on 1 October 2026.

Measure impact

Since 1 October 2026, patients with a long-term condition pay, like other insured persons, the co-payment applicable to medicines with low medical benefit (reduced health insurance coverage, the rest possibly covered by a supplementary insurer). Dependants of occupational accident or disease pension holders lose the co-payment exemption they had.
