Hydroelectric tax limited to non-navigable waterways, CNR fee made proportional to revenue and tax on nuclear reactors increased
Article 36 of the 2003 Finance Act changes the taxation of electricity generation. The tax on licensed hydroelectric plants (Article 302 bis ZA of the General Tax Code) now only applies to plants over 20,000 kW on non-navigable waterways, at an unchanged rate of €2.30 per 1,000 kWh produced; the part due on navigable waterways, paid mainly by the Compagnie nationale du Rhône (CNR), is abolished. The fee paid by the CNR for its concession (Act of 27 May 1921) now includes a fixed part, a part proportional to output and a part proportional to electricity sales revenue. The annual flat-rate tax on nuclear reactors (2000 Finance Act, Article 43) is raised to €1,180,000 per reactor, instead of €610,000. The measure was in Article 16 of the finance bill.
