Mandatory riot cover in property insurance contracts and insurers' solidarity contribution

Article 171 of the 2026 budget act makes cover against the effects of riots mandatory in insurance contracts covering damage to property located in France and to land motor vehicles, with riots being recognised by a qualification commission. It creates a pooling fund for riot risks, managed by the Caisse centrale de réassurance, to which insurers may cede these risks in return for a fee. The fund is financed by this fee and by an insurers' solidarity contribution capped at 1.5% of property and casualty premiums, and benefits from a State guarantee. Entry into force depends on a decree.

Measure impact

Property and motor insurance contracts held by households, businesses and local authorities will have to cover direct material damage caused by a riot recognised by a qualification commission, as well as business interruption losses where the contract covers them. Insurers will pay a solidarity contribution whose rate is set by ministerial order, up to 1.5% of net premiums for vehicle, property damage and business interruption insurance; the law does not say whether it will be passed on to policyholders. The State guarantee to the fund is capped each year at the lower of ten times its expected revenue and €4bn; the State guarantee to the Caisse centrale de réassurance is capped at €3.25bn a year; State advances to the fund may not exceed €1bn in total. The implementing decrees and orders had not been published as of 28 October 2026; according to the press, the drafts presented in October 2026 provide for a 0.8% rate applying from 1 January 2027.
