Occupational diseases: recognition possible outside the coverage time limit, diagnosis rules set by decree

Article 95 of the 2026 Social Security Financing Act amends article L. 461-1 of the Social Security Code: a disease listed in an occupational disease table may be recognised as work-related when only the coverage time limit is not met, after the binding opinion of at least two medical advisers, if it is directly caused by the victim's usual work. A Conseil d'État decree sets general diagnosis rules. Entry into force by decree, at the latest 30 September 2026 (diagnosis) and 1 January 2027 (recognition outside the time limit).
