Historic monuments: fifteen-year holding commitment for the tax benefit
Article 85 of the 2009 Finance Act creates Article 156 bis of the General Tax Code. The deduction of charges specific to listed, registered, approved or Fondation du patrimoine-labelled buildings is conditional on the owner's commitment to keep the building for at least fifteen years from acquisition. It is no longer available for buildings held by non-corporate-tax civil companies, unless approved or a family company whose members undertake to keep their shares for fifteen years, nor for buildings divided from 1 January 2009 without approval. In case of breach, income is increased by a third of the charges wrongly deducted for three years.
