Disability compensation benefit (PCH): rules for people in care facilities
Decree No. 2007-158, implementing Article 12 of Act No. 2005-102 of 11 February 2005, creates a chapter of the Social Action and Families Code on the disability compensation benefit (PCH) in facilities. PCH rules apply to disabled people housed or supported in a social or medico-social facility or hospitalised and, by decision of the departmental council, to those referred for lack of places to a facility in a neighbouring country. In case of a hospital stay or accommodation funded by health insurance or social assistance during the entitlement period, the 'human assistance' component is reduced to 10% of the previous amount, within limits set by order, beyond forty-five consecutive days. As a transitional measure, people applying before 1 March 2007 receive the benefit for costs incurred since 1 July 2006.
