Orphan's pension created in the general pension scheme
Article 18 of the 2023 amending social security financing law creates an orphan's pension in the general scheme (Art. L. 358-1 to L. 358-7 of the Social Security Code) for children whose two parents have died, disappeared or are absent. It equals a percentage of the pension each insured parent received or would have received, set by decree at 54%, with a minimum amount. It is paid up to an age set by decree, extended if the orphan's earnings stay below a ceiling, and without age limit in case of permanent disability. It applies to deaths, disappearances and absences occurring from 1 September 2023.

Measure impact
Children who lost both parents, one of whom was in the general scheme: pension equal to 54% of the parent's pension, with a minimum (€108.57 gross per month according to service-public.fr in 2026), paid until age 21, until 25 if earnings do not exceed 55% of the minimum wage, and without age limit in case of disability.
