Overall cap on income tax benefits (€25,000 + 10% of income)
Article 91 of the finance act for 2009 creates Article 200-0 A of the General Tax Code: the total of certain tax benefits (tax reductions and credits, "Robien" and "Borloo" depreciation, subscriptions to SOFICA film funds) cannot reduce income tax by more than €25,000 plus 10% of taxable income. Several benefits are excluded from the cap, notably those related to donations, employing a home worker or childcare costs. Some overseas investment reductions are counted for only 40% or 50% of their amount. The cap applies from the taxation of 2009 income, for benefits granted for expenditure and investments made from 1 January 2009.
