Rise in the commercial rent index capped at 3.5% for SMEs
Article 14 of the law of 16 August 2022 on emergency measures to protect purchasing power caps at 3.5% the annual change in the commercial rent index (ILC) used to revise rents paid by small and medium-sized enterprises, for the quarters from the second quarter of 2022 to the first quarter of 2023. The part of the rise above 3.5% cannot be recovered at a later revision. The article comes from an amendment by Jean-Baptiste Lemoyne adopted by the Senate.

Measure impact
SMEs renting commercial premises under a lease indexed on the ILC cannot face a rent revision above 3.5% over one year for the indices from the second quarter of 2022 to the first quarter of 2023. Large companies are not covered. The measure has no direct effect on public finances; it limits commercial landlords' income.
