Individuals' capital gains on securities: flat rate raised from 16% to 18%
Article 74 of the 2008 Finance Act raises from 16% to 18% the flat tax rate on capital gains from the sale of securities and company shares by individuals (Article 200 A of the General Tax Code), for sales made from 1 January 2008. Introduced in the National Assembly through an amendment by Gilles Carrez and Yves Censi, the increase was meant to offset the abolition of the stock exchange tax and align this rate with the withholding tax rate. The rate was later raised to 19% and then replaced by the progressive scale from 2013.
