Capital gains on furnished second homes: income tax exemption after 17 years if the home becomes a main residence
Article 150 VC, II of the General Tax Code is reinstated: for the sale of furnished residential premises that have not been the main home for at least a year, the holding-period allowance for income tax would be 8% per year beyond the fifth and 12% for the seventeenth, giving full exemption after seventeen years instead of twenty-two, provided the buyer undertakes in the deed to occupy or let the home as a main residence until 1 January of the third year after the sale (with any lease starting within six months). A subsequent buyer takes over this undertaking on resale; a breach incurs a fine of 5% of the sale price. Applies to sales from 1 January 2027.
