Proportional fee on revenue from renewed hydroelectric concessions
Article 33 of the 2006 Amending Finance Act introduces, when hydroelectric concessions are renewed, a fee payable by the concession holder to the State, proportional to revenue from sales of electricity produced by the conceded facilities (Article 9-1 of the Act of 16 October 1919). Its rate is set by the concession deed, up to 25% of revenue; 40% of the proceeds go to the departments through which the rivers used flow. The article also adjusts the energy reserves due to departments. The fee applies as concessions are renewed.
