New regime for State public-domain fees on electricity networks
Decree No. 2026-98 creates Articles R. 323-49 to R. 323-54 of the Energy Code and sets the fees owed by electricity network operators for occupying the public domain of the State and its public bodies: notably €1 per kilometre of network per year for transmission assets (RTE and EDF extra-high voltage), and €0.02 × P per year for distribution networks, P being the population of the municipalities concerned. It repeals Decree No. 56-151 of 27 January 1956.

Measure impact
Electricity transmission and distribution operators pay a fee under this new schedule for their assets on State public land. For existing authorisations and agreements, the new regime applies only from 1 January 2027.
