Early retirement from 55 for disabled insured persons
Article 24 of the Pension Reform Act of 21 August 2003 creates Article L. 351-1-3 of the Social Security Code and its equivalent for craftsmen and traders: the retirement age is lowered for disabled insured persons who, while having a permanent incapacity at least equal to a rate set by decree, completed a minimum insurance period, partly contributory. Decree No. 2004-232 of 17 March 2004 allows retirement between 55 and 59 depending on the insurance and contributory periods, which are 40 to 100 quarters below the period required for a full pension. The incapacity rate used is the one required for the disability card. The decree applies to pensions starting after 30 June 2004.
