Early retirement for civil servants with three children opened to both parents subject to a career break
Article 136 of the 2004 Amending Finance Act rewrites Article L. 24 I 3° of the civil and military pensions code. Early retirement with no age condition is open to civil servants who are parents of three living children (or children who died as a result of war), or of a child over one year old with a disability of at least 80%, provided they took a career break for each child under conditions set by decree. The scheme, previously reserved for mothers, is thus opened to fathers who meet the condition. It applies to claims not yet settled by a final court ruling. Decree No. 2005-449 of 10 May 2005 sets out the details.
