Contribution on 'top-hat' pensions extended to annuities paid out before 2011 (7% and 14%)
The 2011 Social Security Financing Act (Article 10) created a contribution payable by recipients of defined-benefit supplementary pension annuities (Article L. 137-11-1 of the Social Security Code). Article 16 of the 2011 Finance Act, from a Senate finance committee amendment reworked by the joint committee, rewrites that article by distinguishing two cases. Annuities paid out before 1 January 2011 are taxed on the share above €500 a month, at 7% between €500 and €1,000 and 14% above. Annuities paid out from that date are taxed once they exceed €400 a month, at 7% between €400 and €600 and 14% above. These thresholds are indexed to the social security ceiling. The scale was replaced on 1 January 2012 by a scale including a 21% bracket.
