Negotiated termination for civil servants made permanent and the specific severance payment reduced
Article 173 of the 2026 Finance Act writes into the General Civil Service Code (Articles L. 552-1 to L. 552-5) the negotiated termination (rupture conventionnelle) for civil servants, introduced on a trial basis until 31 December 2025 by Article 72 of the Act of 6 August 2019. The specific severance payment remains bounded by minimum and maximum amounts set by decree, with repayment required if the person is recruited back into the same branch of the civil service within six years. Articles L. 552-1 and L. 552-2 are made applicable to civil servants of La Poste and France Télécom. Decree No. 2026-746 of 6 August 2026 lowers the minimum amounts and reduces the cap from one twelfth to one twenty-fourth of annual gross pay per year of service.
