Tax on the sale of bare land made buildable, funding young farmers’ installation
Article 55 of the agriculture and fisheries modernisation act creates Article 1605 nonies of the General Tax Code: a tax applies to the first sale for consideration of bare land made buildable by a planning document (local urban plan, municipal map) after 13 January 2010. It is levied on the capital gain (sale price minus the indexed purchase price), reduced by one tenth per year beyond the eighth year after rezoning. The rate is 5% when the sale price is between 10 and 30 times the purchase price, and 10% on the part of the gain above that. It does not apply if the ratio is below 10, if the price is below €15,000 or in case of expropriation. The proceeds go to a fund for the installation of young farmers managed by the Agence de services et de paiement.
